General provision

These Terms of Purchase and Sale (hereinafter referred to as the Rules) determine the rights, duties and responsibilities of the person acquiring the goods (the Buyer) in the www.litena.lt online store and UAB Litena (the Seller) to the Buyer at the time of purchase of the goods in the online shop. By purchasing goods at the online shop, the Buyer agrees to the application of these Rules.

1. The moment of the conclusion of the purchase and sale contract

1.1.

The Purchase and Sale Agreement between the Buyer and the Seller is deemed to have been concluded from the time when the Buyer, having created the shopping cart in the electronic shop, indicated the delivery address, chooses the payment method and is familiar with these Rules, presses the "Pay" button and is valid until the full performance of the obligations under this agreement. In cases where the Buyer disagrees with all or a certain part of the Rules, he must not submit an order.

1.2.

Each contract concluded between the Buyer and the Seller is stored in the www.litena.lt database.

2. Buyer's rights

2.1.

The buyer has the right to purchase goods at the online shop in accordance with these Rules and legal acts of the Republic of Lithuania.

2.2.

The Buyer has the right, without giving any reason, to refuse the agreement on the purchase and sale of goods concluded with the Seller at the online shop (except for the exceptions below), informing the Seller thereof within 14 days from the date of delivery of the goods.

2.3.

The Buyer has the right to refuse the contract for the purchase. The sale of goods concluded with the seller at the online shop does not apply to orders that do not exceed 10 linear meters.

2.4.

The buyer may return the Luxury Home blanket, but it must be delivered to one of Litena's stores and only after the inspection by the representative of Litena whether the product or the packaging is not damaged the refund may be issued.

2.5.

The buyer has other rights specified in the Rules and the legal acts of the Republic of Lithuania.

3. Buyer's duties

3.1.

The buyer must pay the price of goods and their delivery, as well as other payments (if indicated in the contract) and accept the ordered goods. The Buyer pays for the merchandise through their online bank or by making a payment from any other bank to the Seller's account specified in the "Our Requisites" section.

3.2.

If the data provided in the Customer's registration form changes, the Buyer must immediately update it.

3.3.

The Buyer is required to confirm the payment order using their online banking system or to make a payment from any other bank and send a separate notice to the Seller that payment will be within 24 hours from pressing the "Pay" button. Within this time frame, without the receipt of a payment order or by sending a separate e-mail to the Seller, the Seller is entitled to consider that the Buyer has canceled the purchase and sale agreement. The goods selected by the buyer are reserved and the Seller undertakes to execute the purchase and sale agreement only when the Seller receives a notification from the Buyer's bank or the Buyer about the payment made for the selected goods.

3.4.

The Buyer must comply with the other requirements specified in the Rules and the legal acts of the Republic of Lithuania.

4. Seller rights

4.1.

If the Buyer attempts to harm the work or stable operation of the electronic shop, the Seller may, without warning, restrict, stop (terminate) his access to the online store and is not liable for any related losses of the Buyer.

4.2.

The seller has the right to unilaterally change these Rules by posting them on the online shop’s web site. Changes take effect from the moment of publication for all transactions under post.

4.3.

The Seller has other rights specified in the Rules and the legal acts of the Republic of Lithuania.

5. Seller obligations and warranties

5.1.

The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the online shop.

5.2.

The Seller agrees to comply with requirements specified in these terms.

5.3.

The seller guarantees the quality of the goods.

6. Delivery of goods

6.1.

The goods are presented by the transport (courier) company at the buyer's expense. Goods are delivered at the Seller's expense when the order exceeds 10 linear meters.

6.2.

The exact delivery price depends on the quantity of ordered products ordered (meters).

6.3.

The delivery of the item is covered by the Seller. In individual cases, the delivery of the goods is paid by the Buyer.

6.4.

Usually the goods are delivered to the address indicated by the Buyer within 5 business days of the payment received for the goods and transportation of the goods, if the goods are in the Seller's warehouses. The seller does not warrant that the goods will in all cases be delivered within the time limit specified in the previous sentence, especially if the ordered goods are not in Seller's warehouses. Goods are delivered throughout the territory of the Republic of Lithuania, including the Curonian Spit (additional charge apply).

6.5.

The exact date and time of the delivery of the goods are indicated in the e-mail message to Seller's Buyer. mail to the Customer's registration form. Accordingly, the Buyer, who has entered into a purchase and sale contract, undertakes to check the above-mentioned e-mail every day until you receive a delivery receipt message.

6.6.

At the time of delivery of the shipment, the Buyer or, as the case may be, the Buyer's representative must, together with the representative of the transport company, check the condition of the package, the quantity, quality and range of goods.

In case of violation of the package packaging, the non-conformity of the quantity, quality, assortment of goods, the Buyer or, as the case may be, the Buyer's representative must not accept the consignments. In such a case, the representative of the transport company, together with the Buyer or, as the case may be, shall fill in a special inspection certificate of the buyer's representative stating the violations found.

The buyer or, as the case may be, upon receipt of the consignment by the Buyer's representative and signed by the transport company's agent or the paper delivery confirmation without comments, the goods are deemed to have been delivered intact, the quantity, quality, assortment complies with the terms of the purchase and sale contract, additional services, indicated in the data logger or paper delivery confirmation, if not proved to the contrary.

6.7.

After delivery the goods to the address indicated by the Buyer, the goods are deemed to have been transferred to the Buyer, regardless of whether the goods are actually accepted by the Buyer or any other person who accepted the goods at the address indicated. If the Goods are not delivered on the planned date of delivery, the Buyer shall inform the Seller immediately, but no later than the day after the scheduled delivery date of the goods.

6.8.

If the goods are accepted by the Buyer, the Buyer is obliged to indicate the details of the person accepting the goods by e-mail info@litena.lt.

6.9.

If the buyer indicates that they will collect the goods themselves, they can do this at one of our sales offices in Kaunas, Panevėžys and Klaipėda.

7. Responsibilities

7.1.

The buyer is responsible for the accuracy of the data provided in the registration form. The buyer assumes responsibility for the consequences of the mistakes or inaccuracies in the data submitted in the registration form.

7.2.

The parties are liable for violation of the purchase and sale agreement concluded using the electronic shop in accordance with the procedure established by legal acts of the Republic of Lithuania.

7.3.

Taking into account Article 8 part 3 of the Law on the Electronic Signature of the Republic of Lithuania the Buyer and Seller agree that the confirmation of the Customer's actions in the e-shop for the access to the e-shop data (identification code) is subject to Article 8 part 1 of the Electronic Signature - the legal validity of the electronic signature (i.e., has the same legal force as the signature in written documents and is permissible as a means of proof in court). The buyer must keep his/her access to the e-shop data and not to disclose it, ensure that the data is known only to him and the data is used only by himself, not transmitted and otherwise not make it possible for other persons to access or use those data. In case of suspicion that the login data may have been discovered by another person, immediately notify the Seller thereof, as well as immediately inform the Seller about the violation or disclosure of the access to the online store. All actions performed using the Buyer's Identification Code are deemed made by the Buyer and the Buyer assumes full responsibility for the consequences of such actions.

7.4.

The Seller is not liable for the information provided on the websites of other companies, even if the Buyer enters the following links through the Seller's Online Store.

7.5.

The seller is not responsible for the fact that the goods presented in the e-shop by their color, form or other parameters do not correspond to the actual size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.

8. Personal data processing

8.1.

By clicking on the "Pay" button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agrees to provide the Seller with the personal data specified in these Rules and the registration form and does not object that the Seller will manage the online information provided by the Seller and/or his representatives. for trading purposes.

8.2.

By clicking on the "Pay" button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agrees that the personal data provided by the Buyer and/or his representatives to the Buyer and/or his representatives should be provided to the third parties chosen by the Seller, that these They will be processed for the purpose of online trading, as discussed elsewhere.

8.3.

By clicking on the "Pay" button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agrees to pick up the goods at the place of delivery at the place of delivery to the Seller and/or the third person, upon delivery of the goods by the Seller, one of the identification documents of the person: Identity card, new model driving license, in order to properly identify the Buyer and/or his representatives for the purpose of online trading. The Buyer also confirms that he and his representatives (the Buyer has the consent of his representatives) agrees that at the time of withdrawal of the goods, the Seller and/or the third person, upon delivery of the Goods by the Seller, upon handing over the Goods, shall note the identification of the person represented by the Buyer and/or his representative document data and processing this data (including, but not limited to, data transfer to the Seller) for the purpose of online trading.

8.4.

By ticking the item "News subscription", the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agrees that the Seller's personal data of the Buyer and / or his representatives submitted to the Seller will be processed by the Seller for the purpose of direct marketing. The Seller specifies that the Seller will not manage the Buyer (if this is a natural person) and his/her personal identification number for direct marketing purposes.

8.5.

By ticking the item "News subscription", the Buyer indicates that he and/or his representatives (the Buyer has the consent of his representatives) agrees that the personal data submitted to the Seller will be provided to the third parties selected by the Seller for the purpose of direct marketing, as discussed in the next sentence. By ticking the item "News subscription", the Buyer indicates that he and/or his representatives (the Buyer has the consent of his representatives) agrees to receive information and promotional materials about the services, the goods from the Seller and/or his/her chosen third party registration form and/or other address given by the Buyer, his representatives, by SMS, by calling to the indicated mobile telephone number, by e-mail.

8.6.

By clicking on the "Pay" button, the Buyer confirms that he (if the Buyer is a natural person) and his representatives are informed about their right to access the personal data processed by the Seller and how they are processed, request the correction, destruction of their personal data or suspension of their personal data processing operations where the data are processed in breach of the provisions of the law, to refuse to process their personal data for any purpose.

8.7.

By clicking on the "Pay" button, the Buyer confirms that he and his representatives know that they have the right to refuse to provide their personal data, but understands that personal data are necessary and necessary for the purpose of uniquely identifying the Buyer and / or his representatives for the purposes of online trading and without providing the personal and / or refusal to process them for the purpose of online trading will not be able to conclude and / or enforce the agreement.

9. Sending information

9.1.

The seller sends all messages to the e-mail address provided by the Customer registration form.

9.2.

The buyer sends all messages and questions by e-mail info@litena.lt.

10. Final Provisions

10.1.

These terms do not restrict the rights of the Buyer (user) established in the legal acts of the Republic of Lithuania, including the rights to purchase goods or services of inadequate quality.

10.2.

All disputes arising out of or relating to the purchase and sale agreement between Buyer and Seller are negotiated. Failing to reach an agreement, disagreements shall be resolved in accordance with the procedure established by legal acts of the Republic of Lithuania.
